This Privacy Policy (“Policy”) is provided by PairTree, Inc. (referenced throughout this Policy as “PairTree”) to describe the Personal Information we collect, how we use it, with whom we share it, and the choices available regarding our use of the information. Personal Information is information relating to you that enables us to identify you, for example, your name, email address, payment details and information about your access to this website. We also describe the measures we take to protect the security of the information and how to contact us about our privacy practices. This Policy applies to our website, https://pairtreefamily.com/, our mobile application, and any other website under our control that link to this Policy (the “Services”). By accessing, browsing, or using the Services, you expressly consent to the collection, use, storage, processing, and disclosure of your information, including Personal Information, as described in this Policy. When we refer to “we,” “our,” or “us” in this Policy, that means PairTree.

THE PERSONAL INFORMATION WE MAY COLLECT

Depending on the type and level of engagement you have with us, we may collect information from you directly, indirectly, or from third parties.

Information You Provide To Us

Based on your use of the Services, we may receive and store information you provide directly to us. For example, when registering an account, we may collect Personal Information, such as your name, e-mail address, along with a unique username and password. We may also collect additional information, including your social media addresses, pregnancy due date and other milestones, date of birth, age, information about your medical coverage, some financial information, child preferences, paternity information, personal habits, like drug and alcohol usage, religion, political affiliation, family structure, race/ethnicity, zodiac sign, personality type, education and professional history, gender (including gender identity), as well as any other contact or other information you may choose to provide us or upload to our Services. We may collect any Personal Information that you choose to send to us or provide to us, for example, on our “Sign Up” online form. If you contact us through the Services, we will keep a record of our correspondence.

Information We May Collect about Your Interaction with the Services

We collect additional information about your interaction with the Services, by using cookies or similar technologies on our Services. For example, we receive certain information, such as your Internet Protocol (“IP”) address, browser type and language, access times, and referring website addresses, and pages of the Services that you visit.

Information We May Collect From Third Parties

We may also receive Personal Information about you from various third parties, including:

    When you have a demo call;

We may also use this information to store information about your device so that you will not have to re-enter it the next time you visit the Services; to monitor aggregate metrics such as total number of visitors or pages viewed; or to track submissions in any interactive portion of the Services. HOW WE SHARE YOUR PERSONAL INFORMATION

Public

To increase the likelihood of connecting expectant mothers with adopting families, profiles for adopting families are publicly available through the Services (profiles of expectant mothers remain private). At this time, our settings do not allow user profiles for adopting families to disable this feature. Adopting families are not required to provide all information that may be requested through the Services. Rather, you may choose not to provide us with certain information. However, if you choose not to provide certain information, certain features offered through the site may not be available to you.

Agents, Affiliates, and Service Providers

We sometimes share your Personal Information with our trusted categories of third parties we use to conduct our business, for example: to handle feedback and complaints; and to help us understand your behavior in order to customize our services, advertising, marketing, and offers to you.

Our trusted categories of third parties include website hosts, cloud service providers, social media providers, professional services providers, customer survey service providers, and marketing partners.

As part of our outreach methods, we use some Google services and some Meta products in accordance with the practices explained in the Google and Meta terms and privacy notices. As part of our fraud monitoring, detection, and prevention methods, we use a third-party to assist us with this service. As part of this service, we may share

Personal Information that is required to conduct identity verification, any information produced from such identify verification process (including information relating to your age, name, and location), and account information with third party organizations involved in fraud prevention and detection and credit risk reduction (including law enforcement agencies). Please note that these third parties may retain a record of the information that we provide to them for this purpose.

We may share your Personal Information with government bodies and law enforcement.

We may also share your Personal Information with our professional advisers including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services.


MARKETING, OUTREACH, AND COOKIES

Marketing

We may send you marketing communications:

  • if you have created an account with us or subscribed to our Services, and you have not opted out of receiving marketing;
  • by email if you have signed up for email newsletters;

We may use your Personal Information (as outlined in the ‘Personal Information We May Collect’ Section) to form a view on what we think you may like, or what may be of interest to you, and to send you details of services which may be relevant for you.

We will ask you for your preferences in relation to receiving marketing communications by email, and other communication channels.
You will always have full control of your marketing preferences. If you do not wish to continue receiving marketing information from us (or any third party, if applicable) at any time:

  • you can unsubscribe or ‘opt-out’ by using the unsubscribe button and following the link included in the footer of any marketing email; or
  • account holders may withdraw their consent by simply logging in to the PairTree, Inc. Privacy Center and managing their preferences.

We will process all opt-out requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.

Cookies

Our Services use cookies to distinguish you from other users and to keep track of your visits. They help us to provide you with the very best experience when you browse our website and to make improvements to our website. They also help us and our advertising networks to make advertising relevant to you and your interests.

Our Use of Analytics and Targeted Promotional Tools

We use a range of analytics and targeted promotional tools. We use these tools to deliver relevant content in marketing communications (where applicable), and to measure the effectiveness of our outreach. For example, we use tools such as Google Analytics to target and improve our marketing campaigns, marketing strategies and website content. We may also use tools provided by other third parties to perform similar tasks. “DO NOT TRACK” SETTINGS

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the “Do Not Track” signal, their web browser sends a message to websites requesting that the user not be tracked. Our Services respond to “Do Not Track” signals.


PROCEDURES FOR LOCAL, STATE AND FEDERAL INFORMATION COLLECTIONS/ LAW ENFORCEMENT REQUESTS

Federal government information collections must comply with the Paperwork Reduction Act. 44 U.S.C. § 3501, et seq. sets forth requirements governing information collections of the public from federal agencies.  In the absence of administrative procedures governing an information collection, the collection of information is presumed to be for a law enforcement purpose. 5 C.F.R. § 1320.3(c).

No government law enforcement-related information collections may access PairTree subscriber information without a warrant or court order. State or local agencies may not search listings on PairTree’s website for the purpose of identifying individuals in violation of the law without first obtaining a lawfully obtained subpoena or court order prior to the agency’s search of PairTree’s website. City of L.A. v. Patel, 576 U.S. 409, 419 (2015). The information families provide to bona fide expectant moms on the PairTree platform are electronic communications protected under the law.  Under the Electronic Communications Privacy Act, it is a crime whenever a government employee or agent “intentionally accesses without authorization a facility through which an electronic communication service is provided.” 18 U.S.C. §§ 2701(a)(1) & (b)(2).  Further, consistent with Supreme Court precedent, the Act makes clear that no government employee or agent may access the information of a PairTree user (“subscriber”) without a warrant issued consistent with state or federal criminal procedures or a court order issued by a court of competent jurisdiction via a showing of facts that the information sought is relevant to an ongoing criminal investigation.  18 U.S.C. §§ 2703(c) & (d).

PairTree will respond to lawfully authorized, properly served requests, to the extent permitted by its Terms of Service, Privacy Policy, and US law.  Proper service of government information requests or law enforcement requests should be directed to PairTree’s Registered Agent.

LINKS TO OTHER WEBSITES AND THIRD PARTIES

For your convenience, the Services contain links to other sites (“Linked Sites”). We have no control over, and are not liable or responsible for the privacy practices, terms of use, or content of Linked Sites. The Linked Sites may collect Personal Information from you that is not subject to our control. The data collection practices of Linked Sites will be governed by that site's privacy policy. Please review the privacy policies of any Linked Sites you may access.


SECURING AND RETAINING YOUR DATA

Securing your data

We maintain reasonable physical, technical, and administrative safeguards for our Services designed to protect against loss, misuse, unauthorized access, disclosure, alteration or destruction of the information we collect. Despite these efforts, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee its absolute security.

You are responsible for maintaining the security of your account credentials for the Services. PairTree will treat access to the Services through your account credentials as authorized by you. Unauthorized access to password-protected or secure areas is prohibited and may lead to criminal prosecution. We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. If you believe that information you provided to us is no longer secure, please notify us immediately using the contact information provided in this Policy.

Retaining your data

We will retain your information indefinitely, or as long as legally required or allowed. We may dispose of any information in our discretion without notice, subject to applicable law. We do not undertake any retention obligations through this statement.

Children

While our website is designed for a general audience, we will not knowingly collect any data from children under the age of 18 or sell products to children.
Please do not attempt to sign up to our services, create an account or send any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under age 18, we will delete that information as quickly as possible. If you believe that a child under 18 may have provided us Personal Information, please email support@pairtreefamily.com. Our privacy team will act upon this information as quickly as possible.

Changes to This Policy

We reserve the right to change this Policy at any time, in our sole discretion. We will post changes to the Policy on this page and encourage you to review it each time you visit the Services to stay informed. If we make changes that materially alter your privacy rights, we will take appropriate measures to inform you, consistent with the significance of the changes we make. The updated Policy will govern your use of the Services as of the Effective Date indicated at the top of this Policy. If you do not agree to the updated Policy, you should stop using the Services. Your use of the Services after the Effective Date of the updated version of this Policy will constitute your acceptance of the updated Policy.
